We are committed to providing a safe and enjoyable experience for all our participants. Our Terms & Conditions outline the rules and guidelines that govern your use of our services, including our online classes and booking system. By accessing our website and participating in our programs, you agree to abide by these terms. We encourage you to read through this document carefully to ensure a clear understanding of your rights and responsibilities as a valued member of our community. 1. Passes
1.1 Term Pass:
- Term Passes are class-specific.
- Participants are automatically enrolled in the specified class each week for the duration of the term.
- The number of classes in a term is determined by Victorian school holidays, typically ranging from 9-11 weeks.
- A class recording is provided within 24 hours of each class via a secure link, accessible for 7 days (subject to technical difficulties).
- Term Passes cannot be refunded but may be transferred to another class or future term in exceptional circumstances (e.g., medical issues), at the discretion of Third Age Fitness. Requests must be made in writing to Carol via our Contact page and it will be evaluated on a case-by-case basis.
- Each Term Pass is valid for one individual participant only. Multiple participants in the same household must each have their own Term Pass.

1.2 10 Class Pass (30mins):
- Participants can book into any 30-minute class on the timetable, subject to availability.
- Valid for 180 days (6 months) from the date of purchase. Unused classes expire after this period without refund or extension.
- Classes can be booked up to 6 weeks in advance through the online booking system.
- Each 10 Class Pass is for individual use only. Multiple participants, even if in the same location, must each have their own pass and make separate bookings.

1.3 10 Class Pass (45mins):
- Participants can book into any 45-minute class on the timetable, subject to availability.
- Valid for 180 days (6 months) from the date of purchase. Unused classes expire after this period without refund or extension.
- Classes can be booked up to 6 weeks in advance through the online booking system.
- Each 45-minute 10 Class Pass is for individual use only. Separate bookings are required for each participant.

2. Cooling Off Period
- A 24-hour cooling off period applies to Term Passes and 10 Class Passes from the time of purchase.
- Participants may cancel their purchase within 24 hours of purchase for a full refund by emailing Carol via our Contact page.
- Refunds will be processed within 5-7 business days to the original payment method.
- The cooling off period does not apply to individual class bookings or after a pass has been used to book a class.

3. Transfers
- No transfers of passes or classes are allowed between participants, to ensure fairness and proper class management.
- In exceptional circumstances, requests for transfers may be considered at the discretion of management. These requests must be made in writing to Carol via our Contact page.
- If a transfer is approved, an administrative fee may apply.

4. Participant Responsibilities
- Participants are responsible for notifying Third Age Fitness of any changes to their contact or medical details, including email address, phone number, mailing address, emergency contact, and health issues.
- Updates can be made through the participant's online account or by emailing Carol via our Contact page.
- Failure to update contact information may result in missed communications or inability to access classes, for which Third Age Fitness cannot be held responsible.
- Each registration allows only one participant to attend. Multiple people in the same room using one registration is strictly prohibited. Each individual must have their own registration and booking, even if participating from the same physical location.
- Participants are responsible for ensuring they have a suitable space to exercise safely during online classes.

5. Class Bookings and Attendance
- Participants are responsible for booking their classes through the online booking system and attending at the scheduled time.
- No refunds or credits will be given for missed classes, regardless of the reason.
- We recommend setting up calendar reminders to ensure attendance.
- If a participant is unable to attend a booked class, they are encouraged to cancel their booking as soon as possible to free up the spot for others.
- Consistent no-shows may result in a warning and potential suspension of booking privileges.

6. Technical Requirements
- Participants are responsible for ensuring they have the necessary technology (TV, computer, or tablet) and a stable internet connection to participate in online classes.
- A minimum internet speed of 5 Mbps is recommended for optimal video quality.
- Third Age Fitness is not responsible for any technical issues on the participant's end that may prevent class attendance.
- Participants are encouraged to test their setup before class. Participants can use our Zoom Set Up Guide to ensure they are doing so correctly.
- In case of technical difficulties during a class, participants should use the Zoom Troubleshooting Guide. If they disconnect, they may be allowed back into class at the instructor’s discretion, and at a time suitable to the instructor, to ensure the ongoing safety of all participants.

7. Health and Safety
- Participants are strongly advised to consult with a healthcare professional before starting any new exercise program, especially if they have pre-existing health conditions.
- Participants are responsible for their own safety during classes and should exercise within their personal limits.
- Instructors may provide modifications for exercises, but participants should use their judgement in following these.
- Participants should immediately stop exercising and seek medical attention if they experience chest pain, shortness of breath, dizziness, or other concerning symptoms during a class.
- Third Age Fitness reserves the right to request a medical clearance from participants if there are concerns about their ability to safely participate in classes.

8. Privacy
- Our Privacy Policy details how we collect, use, store, and protect personal information in accordance with applicable privacy laws.
- We do not sell or share personal information with third parties for marketing purposes.
- We may use anonymised data for research and service improvement purposes.
- We retain personal information only for as long as necessary to provide our services and comply with legal obligations.
- Participants have the right to request access to their personal information held by Third Age Fitness. Requests for access to personal information should be made in writing to Carol via our Contact page.
- All classes are recorded for quality assurance, participant safety, and broadcasting.

9. Changes to Terms and Conditions
- Third Age Fitness reserves the right to modify these terms and conditions at any time to reflect changes in our services or legal requirements.
- Participants will be notified of any significant changes via email at least 14 days before they take effect.
- Continued use of our services after changes take effect constitutes acceptance of the new terms.
- A current version of the Terms and Conditions will always be available here on our website for review.

10. Governing Law
- These terms and conditions are governed by the laws of Victoria, Australia.
- Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
- Participants agree to attempt to resolve any disputes directly with Third Age Fitness before seeking legal recourse.

11. Payments
- No additional fees, such as credit card fees or state taxes, apply to our advertised prices.
- Payments are securely processed via Stripe, a PCI-compliant payment gateway.
- Payments and pass deductions occur immediately upon booking.
- Price change notifications will be sent via email with at least two weeks' notice before implementation.
- Service changes (e.g., class cancellations) may occur due to unforeseen circumstances. We will notify participants as soon as possible via email.
- In the event of a price decrease, no retroactive refunds will be issued for passes purchased at the higher price.

12. Cancellation
- Third Age Fitness reserves the right to cancel memberships, passes and bookings for violations of Terms & Conditions or Code of Conduct without refund.
- This may occur immediately for serious breaches or after warnings for minor infractions.
- Users may cancel class bookings via their account portal at any time.
- Full refunds are available for cancellations made more than 12 hours before the scheduled class time.
- No cancellation fees apply. Participants will be refunded according to their payment method.
- In the event of instructor illness or technical issues, Third Age Fitness may need to cancel a class at short notice. In such cases, participants will be offered a makeup class, credit or refund, depending on their payment method and preference.

13. Instructor Changes
Third Age Fitness reserves the right to change, substitute, or replace instructors for any class at our discretion, without prior notice. While we strive to maintain consistency and clear communication, there may be occasions when last minute instructor changes are necessary due to unforeseen circumstances, illness, or technical issues. An instructor change does not qualify as a valid reason for cancellation. Participants who cancel a class due to an instructor change within this 12-hour period will forfeit their right to a refund or class credit, as per our standard cancellation policy.

14. Suspension
- Term Passes or 10 Class Passes cannot be suspended.
- In exceptional circumstances (e.g., extended illness, injury), the validation period for passes may be extended.
- Requests for extensions must be made in writing to Carol via our Contact page and will be considered on a case-by-case basis.
- Supporting documentation, such as a medical certificate, may be required for extension requests.
- If granted, the extension period will be added to the original expiration date of the pass.

15. Code of Conduct
- Participants must have their video on during classes for safety and interaction purposes.
- Appropriate attire is required: no bare chests, open-toe shoes, or overly revealing clothing.
- Participants must provide their own equipment as specified for each class (e.g., chair, resistance band, weights).
- Respectful behaviour towards instructors and other participants is expected and required at all times.
- Inappropriate language, gestures, or behaviour will not be tolerated and may result in immediate removal from the class and potential termination of the participant's pass.
- Participants should arrive before the scheduled start time and be prepared to start the class promptly.

16. Personal Harm
- While we prioritise safety, Third Age Fitness and its employees are not liable for injuries resulting from incorrect use of equipment, improper execution of exercises, or non-adherence to instructor guidance.
- Participants must complete an Intake Form before their first class and inform instructors of any relevant health changes or daily limitations.
- We reserve the right to refuse participation and remove participants from class if we believe it may be unsafe for the individual.
- In case of injury during a class, participants should immediately stop exercising and seek appropriate medical attention from a third party.
- Any incidents occurring during class must be reported to the instructor immediately and followed up with an email to Carol via our Contact page within 24 hours of the incident.

17. Class Bookings
- Bookings can be made and cancelled through the participant's online account.
- Full refunds are provided for cancellations made with more than 12 hours' notice.
- No-shows forfeit their booking without refund.
- Late entry is allowed up to 5 minutes after the class start time, after which entry may be denied for safety reasons.
- Each participant must have their own booking, even if multiple participants are joining from the same physical location.
- Sharing of login details or allowing multiple people to participate under one booking is strictly prohibited and may result in termination of the pass.

18. Website
- Our website Terms of Use and Privacy Policy are always available.
- All content, including text, images, and videos, is copyrighted and the intellectual property of Third Age Fitness. Unauthorised use, reproduction, or distribution of our content is strictly prohibited.
- Filming, screen recording, link sharing, or unauthorised broadcasting of classes, both live and on demand, is strictly prohibited.
- While we strive to keep all information on the website current, we cannot guarantee the accuracy of all content at all times.
